Marriage isn't really just about love and feelings. It's a legal contract to form a lifelong partnership, pretty much for the purpose of raising a family and providing a stable environment for children. Relationships are easy to get out of, contracts are not.

If you weren't serious and committed about staying together, for practical non-emotional reasons, then you shouldn't have been married. It's not just a big gesture to say "I love you," it's intended to be a serious decision and a commitment that you don't break for no reason.

Her soon-to-be ex-husband is a complete douche. He's cheated on her multiple times. They have two children together. It's a nightmare. I would like to entertain the idea of making his life hell. My main question is would any anons be interested in being malicious?

I would go in and talk to someone in the church and politely request that they don't discuss it, as this is a matter for your family. Verbally tell them that if they don't comply, you will consider it an act of harassment. Bring someone who will witness it, and/or write up a formal request that it not be discussed on Sunday and have it signed. The formal request should have notice that if not regarded, you will consider it an act of harassment.

If, after you have politely tried to solve the issue with them directly (hopefully with the signed request), go talk to a lawyer.

This is harassment.

You will probably be disbarred or whatever from your church (I don't go, so I can't really help with that). I'd assume that after this you wouldn't want to too much anyway.

Theoretically, it's protecting women. These laws were all developed under a system where men were still assumed to be the bread-winners in the family, and it wouldn't be cool for them to just dump their wives on the street without a penny as soon as they "fell out of love." These laws are also protecting children, from basically the same thing.

This is the reason why marriage isn't meant to be an impulsive, purely emotion-based decision. People don't really take it seriously anymore, and then they're surprised when they have to take serious measures to break the contract.

Do you live in America? Have you ever had a divorce in your family?

It's ugly, ugly shit. I don't think there's such a thing as a "clean break," if it goes to the courtroom, they're going to dig up all your secrets and personal kinks/habits and basically drag out your entire private life and relationship as "evidence." Divorce lawyers can be vicious and downright sociopathic, because that's the job, it's all about deciding, in a formal legal matter, who is at "fault," who is the "bad guy," so it can be decided who gets the kids and who gets how much money.

They'll use the kids as pawns and weapons, they'll use any little piece of embarrassing personal information as a weapon, no matter how petty. It is not fun, it is not clean, it is not easy

If you told a friend a secret, they'd have every opportunity to violate your trust and share it. That's their choice and it's why you pick your confidantes carefully. Well these guys have been informed of a private matter and decided to make it public. That's also their choice. It's not exactly intimidating. It's life. Everyone has to live (and keep living) with the knowledge that some people will suck.

You only need consent when you're petitioning at-fault.

I think you've got that backwards, anon. No-fault divorce is when both people willingly sign the papers and get on with their lives. An at-fault divorce is the kind that goes to a courtroom to be argued and decided by a judge. These are the cases, like OP's, where one person is arguing that they should be released from the marriage, and the other person doesn't want that to happen.

Where consent is required is in a settlement. And even that wouldn't really hold shit up for long, because it could always go to trial. And then there'd be an equitable division of marital property.

What actually does hold up divorces and make them nasty is when there are children involved. And even then, that will never prevent a divorce unless the petitioner gives up (usually because they realize they'll never get custody).

And, if I recall correctly, the vast majority of jurisdictions have completely abolished at-fault divorces because they just lead to all kinds of perverse incentives for petitioners to destroy their spouse's reputation in order to force their hands into agreeing to a more favorable settlement.

Yes, and a party can lose that by default by failing to acknowledge the service of process. So the husband can simply decide to ignore the filing and he will automatically lose in 30 days.

No. That's a settlement. No-fault divorce is where someone petitions the court to grant them a divorce because they don't want to be married anymore. There's no determination of "fault" that would affect how the division of property goes forth. In no-fault divorce there's a simple equitable division of property. The court comes in when it makes determinations of fact and law as to what things are worth and whether they're part of the marital estate. As well as mediating the interaction between the parties in the hopes that they'll settle it on their own.

This isn't even half as bad as the "perverse incentives" ($$$) for the lawyers and judges to drag these cases out, make them as time-consuming and complicated as possible.

This is often how people become motivated to destroy their partner's reputation - it isn't purely greed. Their legal fees become so inconceivably huge that they feel they HAVE to win the case in order to get their legal fees paid off. And the lawyers are there, every step of the way, pushing them and guiding them on how to completely destroy a person in a courtroom.

It's a fucking horrendous system, and it's very far from "completely abolished"
