If someone invades my personal space do I have a right to remove them from my space?

So I don't like being hugged under certain circumstances.
Mostly when used as some kind of joke because of some shit that happened when growing up. Its similar to a phobia. Usually I'm fine but when people are doing it are ingenuinely or attempting to I move out of the way or something because it feels horrible.

My cousin is one of em that likes to do this.
I'm 20 he's 18.
Sometimes the dude does it or says he will to, in his words, piss me off.
I have told him not to touch me multiple times during the lead up. He does I anyway about half the time and I say to let go. If he squeezes me I elbow his kidney or palm the lower part of his ribcage to get him to stop(depending on which angle he comes from).

No one but my mom seems to give a fuck and she tore into me about how I'll be arrested if I do. Since he knows I have this issue and does it anyway shouldn't he also be charged with something?

She went on about how

I understand where she is coming from and understand him in that regard because I had to do something similar but the context of this is different as far as I'm aware especially seeing as I don't invade peoples boundaries unless they are cool with me doing so or I wasn't aware.

I do have documentation of whatever this psuedo phobia is as well if that matters.
