So I am in a difficult situation with my roommates and I want to leave.

My landlord has my last month rent + deposit. I'm on the lease.

The lease is only 1-2 months old.

I could find someone and the landlord might give me my money back, or I could just leave without doing anything.

I am not sure what the specific procedure is for something like this. I know that I can just sublease, but then I won't get my deposit/rent back.

1 yr lease from what i gather.. i dont remember fully lol

its kind of strange, the landlord is renting out by rooms right now

You don't know? How stupid are you? If you signed a lease for a year, then you're locked in for a year. You might be able to move out if you can sublease and find a new tenant, but based on the fact that you don't even know what sort of lease you have, I would advise you to double check whether or not you can actually sublet

its a 1 yr lease.

so its not possible to get deposit back if i signed a year? even if i find the new tenant who can provide the deposit?

No, it's not. You get your deposit back at the end of the lease, unless it was a condition of the lease that it pays for X number of weeks' rent.

Do not "just leave". You are legally responsible for the rent for the full year, and can be sued for the full amount.

Try each of the following until you get agreement - in writing - on one.

1. Ask the landlord to cancel the lease or take your name off it. Depending on how easy it is to re-rent, he might be willing. You will be responsible for rent until he gets someone else.

2. If you're on a joint lease with your roommates, ask them and the landlord to write a new lease without your name on it.

3. Find someone to move in in your place, and ask the landlord to replace your lease with one in the new person's name.

4. Find someone to take your room and pay the rent, effectively subleasing to him. You will still be legally responsible for the rent if he doesn't pay.

Usually you'd find someone new to take on the lease and contribute your proportion of the deposit. You'd be taken off the lease and they'd be put so you'd get your deposit back as your tenancy would have ended and now they'd be liable.

so i take it as long as i find a new reliable person to take over, my landlord shouldn't have a problem with canceling my lease for a new person

or do they like to just keep all the deposits until they are legally required to give it back

do this and you will lose your deposit extra rent and they will come after you for more rent

why not ? new tenant has to pay those fees or you will get deposit back at end of lease

if you want to get completely off the lease go talk to apart mgr after finding another person to take your place

some places will do this some won't
