The man who lives above me wakes up at 4:30 am everyday, I spoke to him and he assured me this is how it always will be (even on weekends). He also told me the reason it is extra loud is because he is also "throwing a lot of things away" which means dragging things across the floor and then throwing them into a corner of his hoarder style apartment. The floors are very thin and it's excruciating.

I've only moved in with my girlfriend to an otherwise beautiful apartment two months ago. So I don't have the option of moving without breaking the lease.

How do we get him to stop?

It's a a smaller apartment building (only about 8 units) all filled sadly.

Complain to the owner/manager/rental agent. Every lease has a "quiet hours" clause, and he can be evicted for not honoring it.

Stop being a dick. He's healing himself of the serious hoarding problem he has. If anything you should be helping him declutter because it's the right thing to do. A lot of normal people get up to work at 4:30a what the fuck do you do for a living anyhow that you can bitch about someone getting up early to be productive? You can bitch to your landlord if you want (which I hopes he dubs ya shit and tells you to deal with it). Maybe try playing relaxing white noise or music while you sleep so you won't hear as much of a racket. Maybe get some ear plugs. If your landlord is aware of his hoarding and all that entails I doubt you'll be getting much support from him. Check your lease.

He isn't getting up for work at 4:30 he says he leaves for work around 7:30, he isn't getting ready for 3 hours.

He also isn't decluttering he is moving his clutter around, like the metal table he dragged up 4 flights of stairs at 5am.

Apartment living totally sucks. I was in a very similar position when I was in grad school. My stress levels were through the roof!

Question: When you confronted your neighbor about the noise, did you tell him that was waking you up? Did you ask if he could do that another time? Did he just flat out refuse to honor your request?

I am asking because your apartment probably has quiet hours. If he is continuing to be noisy during them, talk to your landlord. Unfortunately, it might not solve the problem though since these things are typically "he said, she said" and the landlord can't really prove your neighbor is dragging shit across the floor early in the morning. But possibly your other neighbors might hear noise too? Talk to them. If more than one neighbor complains, it can be grounds for the landlord to take more serious action.

Otherwise, if nothing can be done, invest in some earplugs or try to move to another unit or complex. It is super shitty if your neighbor isn't respecting you. Unfortunately this is common in apartment living.

I told him that he has been waking my girlfriend and myself up every day this week, I asked him if there is another time he'd be able to do whatever he does, sadly he told me that this is his routine. So more or less "he just flat out refuse to honor your request".

em he shouldnt be throwing things away at 4:30. like i rise at 3 everyday but i have the sense to keep the noise down until 8am like NO ONE should be making loud sound before the sun has even risen. talk to your landlord and find out if they are willing to intercede on your behalf.

Also its a fire hazard to hoard things in an apartment building at the least and might even be against city ordinance depending on where you live, so you might also want to tell them about that as well.

I am a landlord so here it goes from my perspective.

You need to call your landlord and explain and see what the landlord will do.

Contrary to the comment earlier, not all leases contain quiet hours. However, most leases have an express or implied "quiet enjoyment" statement. This does not actually mean that quiet will be enforced, only that your ability to live in the apartment will not be impeded. You can make the argument that his activity is precluding you from living in the apartment.

Ask the landlord to say something to him. If the landlord refuses, ask him to nullify your lease.

If the landlord refuses, you should make audio recordings of the noise and document the times and send these to the landlord after a week and ask again.

If landlord refuses action, most states and cities have a landlord/tenant act. get a copy and find some loopholes and threaten your landlord with them.

Most landlords at this point will let you leave just for the sheer fact that it is easier than dealing with you. If still no relief, go to the courthouse or call legal aid society and ask for legal assistance. This is pretty common and you should find recourse pretty easily.

You can also call the police and make a complaint about disturbing the peace.
