Daily Reminder that your supreme court cannot issue legislation, therefore gay marrage isn't legal. It has not passed through the senate or the house, it has not been signed by the president, and therefore it is not a legal right now.

Well technically most states don't have the genders of the parties explicitly outlined in law's regarding marriage, it's more implied. What the Supreme Court said was that it was illegal to not allow lgbt couples access to those same benefits and rights, and that gendered language in marriage laws was illegal, thus forcing the de facto enforcement to change without actually requiring any new laws. No need for a new law specifically for gay marriage.

Supreme Court can interpret legislation however, and has interpreted that refusing to recognize gay marriage is a violation of the Constitution. So regardless of the fact that no new law legalizing gay marriage has been passed, for all intents and purposes gay marrage is legal throughout the United States. Some states still have laws on the books that say marriage is only between a man and a woman, however those laws are technically in violation of the Constitution, and if a state actually tried to enforce those laws they would get in trouble with the federal government.

The court didn't issue legislation, merely ruled if preexisting legislation violated the supreme law of the land. Judicial Review, look up federalist papers like 80 or so.

Trolls are like little exercises. Of course you never win against them but if you feed them they give even more ridiculous problems to ponder.

You're about a few centuries too late there buddy.

The Supreme Court can pretty much do whatever they want, the only checks are impeachment (if they do anything explicitly illegal, not for making rulings that people disagree with) and presidential appointments. They don't even have term limits.

Read the federalist papers. I think no. 80 is the judiciary and covers judicial review (read the whole thing, the conservative judges pick and choose the words to suite their arguments) If it is such an issue, the legislature can simply pass amendments to clarify that gays can't get married.
