Written law is a new enough idea and flying a tricky enough magic that there aren't any particular laws against it anywhere. If you hurt someone or destroy someone's property you'll probably be expected to repay them somehow, though.

If you're a mage you'll have your device taken away and be forced to perform menial labour such as casting sealing rituals onto city walls for a certain amount of time (which is also why city walls are still relevant; Armour tech outpaces other shit by miles).

If you're a bloodline sorcerer you're part of the military and your CO will probably decide.

If your primary customer base consists of witches who're not personally at risk by the defect, then increasing prices to cover safety features is going to hurt sales bad. Would you buy a car with a sophisticated cattle-catcher-esque contraption for a bumper that safely scoops up pedestrians and shunts them aside if you could get the exact same model of vehicle sans device for $6,000 cheaper?

Of course you wouldn't. Anyone cared would just buy the cheaper car and try not to hit people in the first place, while those who don't care would buy it just to save money. Your market consists only of witches who care about bystanders but are too incompetent to fly.

Assuming they didn't kill themselves in the process, the punishment is the same as misusing or abusing any magic.
A small trial will be held within which-ever order, coven or temple they belong to from among the accused's peers.
Typically it'll be two fines, one paid to their organisation and one to whom ever was most affected of those outside the organisation. Typically this is the local mayor or equivalent.

My setting is currently in its Ancient Greece/Roman Empire time. Magic (or at least flying magic)is not that common in the first place, and lawmakers are too busy coming with the first legal codes concerning formal trading,crime,war,citizenship and such. In short, there are no written laws about it, but I figure if a drunk witch crashed in a crowded alley and killed some children people around wouldn't be too entusiastic.
