By not policing it they're basically saying "we want your money and we don't really care if you're having a good experience or not." Every time you connect it should do at least a preliminary test of your connection that measures latency and packet loss and warn you if you don't meet minimum standards in order to have lag-free gameplay, and block you if you fall below a certain threshold
Most online multiplayer is server based where the person with the bad connection is the only one who suffers, but since this impacts everyone who's in the match it's really in everyone's best interest
Lucky for you I guess they'd never actually do this, and I just leave stuttering lobbies anyway.
